Jussie Smollett  and the City of Chicago can just not seem to settle.

Jussie is now suing the city to drop their lawsuit against him to pay back funds they used investigating his alleged race and homophobic  attack case back in January. The city accused Jussie of staging the whole thing and wasting their resources. They sued him for $130,106.

Last month, a judge refused to throw the case out against Jussie, saying that “the city must prove the truth of these allegations to prevail at summary judgement or trial.” Jussie says the $10,000 he was mandated to pay should have been enough.

In the 49-page response to the lawsuit, Smollett gears his accusations against the city, the Chicago Police Department, detectives Michael Theis and Edward Wodnicki, CPD Supt. Eddie Johnson, and bodybuilding brothers Abimbola and Olabinjo Osundairo. Smollett’s lawyers say statements by the Osundairo brothers, who said they helped orchestrate a fake attack on the actor, were self-serving, designed to avoid criminal charges. Still, police used the claims to pursue Smollett’s prosecution.

Jussie’s lawyers say the indictment cause economic harm, “humiliation, mental anguish and extreme emotional distress.” Adding he “voluntarily provided his DNA sample and fingerprints” to FBI agents in early March. They also said his passport was confiscated and “still has not been returned to him to this day.” Ending it by saying, the case came to a close when Jussie was dismissed on all 16 counts of criminal indictment. Also adding that they city already accepted the $10,000 from Jussie, so they should not be able to recover cost.

We’ll keep you posted!
