Bill Cosby, 81, is currently serving 3-10 years in prison for drugging and sexually assaulting Andrea Constand 15 years ago in his home. Cosby’s attorneys have filed a motion with the Pennsylvania Superior court to appeal his conviction. The motion says the judge on Cosby’s trial failed to file a post-trial opinion that has delayed the appeals court from reviewing Cosby’s conviction and sentence, adding that the judge “trampled” on his rights.
“Mr. Cosby’s right to have his appeal heard in a timely manner by this court is being trampled by the lower court’s inordinate delay in issuing his … opinion,” the motion said.
While the appeal is in motion, Cosby wants to be released from prison on bail. He was sentenced in September, so he has officially served 7 months in prison. According to the motion, bail is justified given his advanced age and “the strong likelihood that his conviction will not stand on appeal.”
Cosby also issued a statement through his legal team accusing Judge Steven O’Neill of displaying “disgust and prejudice” against the ex-TV star. Last year, Cosby’s spokesman called the prosecution “the most racist and sexist trial in the history of the United States.”
As of now, he Pennsylvania state court is reviewing the motion.
